How to tell if a class action settlement is legit

Real settlements do pay out, and they also attract copycats. Run through these checks before you enter any personal information.

  1. It never costs money. No real settlement charges a filing fee, a "release fee", or asks for a gift card. If money has to leave your account, stop.
  2. There is a court case behind it. The notice names the case (Smith v. Company), the court, and a case number. Class settlements in federal court need a judge's approval under Federal Rule of Civil Procedure 23(e).
  3. The website is the one named in the notice. Settlement sites are often plain domains like companynamesettlement.com. Check the exact spelling, and type it yourself rather than clicking a texted link.
  4. It is run by a known administrator. Most are handled by claims administrators such as Kroll, Epiq, Angeion, JND, or Simpluris, and the official site says who.
  5. It does not ask for passwords. A claim form can ask for your name, address, email, and proof of purchase. It should never ask for your online banking password or a full card PIN.
  6. Deadlines are fixed dates, not pressure. Real notices give a specific claim deadline weeks or months out. "Act in 24 hours" is a red flag.
  7. Payment comes after approval. Money is paid after the court grants final approval, never before. See when settlement checks arrive.

Frequently asked questions

Do I have to pay to file a settlement claim?

No. Legitimate class action settlements never charge a fee to file a claim or to receive a payment.

How do I know a settlement website is official?

The official website is named in the court-approved notice and usually in news coverage of the case. It lists the case name, the court, and the settlement administrator.

Is it safe to put my information on a settlement site?

On the official site, yes: claim forms ask for contact details and sometimes proof of purchase. They should never ask for your bank password, a gift card, or an upfront payment.
